Indian Government intends womb banks to legalize surrogacy in India

It’s a safe news to all those intending parents and a great support to those genuine Surrogacy Agencies and IVF Clinic India that renting a womb could soon become a completely legal and hassle-free experience, this applies to both Indian as well as foreign couples looking for surrogate mothers in India. Indian government has accredited ART banks to maintain a database of prospective surrogates as well as to store semen and eggs, along with the other comprehensive details of the egg donors , this is as per the draft of Assisted Reproductive Technology (ART) Bill slated to be tabled in Indian Parliament next session.

These banks involving both private and government - will be accredited by state boards. The board contains registration authority which will maintain a list of all IVF Clinic India and monitor their functioning. "So far we didn't have any law regarding surrogacy. This is a step towards legalizing surrogacy and fixing responsibilities of the parties involved in the process," said Dr Sharma.

These ART banks will be independent of IVF clinics. Oocyte (unfertilized egg) and semen preservation will be their main focus and would also maintain a database of surrogate mothers and their customary information. Apart from bearing all the expenses of the surrogate during the required gestation period, the couple can also give monetary compensation to her. The terms of this agreement being variable would be left to the couple and the surrogate or to the surrogacy agency acting on behalf of couples or surrogates.

This bill proposes few rules for couples from outside India looking for surrogate mothers or Egg Donors from India. Those couples would be required to submit two certificates - one on their country's policy on surrogacy and the other stating that the child born to the surrogate mother will get their country's citizenship. "They also have to nominate a local guardian, who will take care of the surrogate during the gestation period," said Dr Sharma. Here the role of surrogacy agency comes into play who would be of great relief for the indenting foreign parents looking for surrogacy in India.

For whatever reason the Bill is intended to, we also have genuine surrogacy agencies operating in India which didn’t have government authority to recognize their service in this particular industry, one such is Surrogacy Abroad Inc., they act as an intermediary between the intending parents and Surrogates. They also maintain a database of Egg Donors and Surrogates who are approved only after a series of strict medical tests conducted at the IVF Clinics. This Bill would give a great boast for such agencies like Surrogacy Abroad Inc., as they provide a great quality service to the foreign parents who are looking for Surrogacy in India for the affordable prices available here. They assist them with the legal procedures required in India and would provide them with quality surrogates who are taken care directly by these agencies or by some third party agency.

ART experts are now eagerly waiting for the Bill to be presented in the next Parliament session and are hopeful that once passed, it will regularize the IVF industry in the India. This would also be a great boost to the Surrogacy in India as it has been highly recognized globally for its affordable surrogacy pricings.
